RECENT VENTURA COUNTY DUI NEWS

New laws effective January 1, 2007:

Driving under age 21 with a blood alcohol concentration of 0.01% or greater is now a citable offense, and if convicted, the person would be guilty of an infraction.  The zero tolerance laws for minors still imposes a one year license suspension.  

The mandatory driver’s license suspension period has been increased to ten months for persons convicted of a first offense of Driving Under the Influence of alcohol if the individual’s blood alcohol concentration  was .20% or greater, and the court orders an enhanced alcohol treatment program.

Effective September 20, 2005, following a DUI conviction, DMV imposes a mandatory license suspension.  For a first offense, this suspension can be converted to a six month restriction.  Click here for more information about penalties for DUI cases in Ventura County. 

        DUI DEFENSE ACCOMPLISHMENTS

          Working with me in my office is a licensed investigator who was a former Ventura Police officer with extensive experience in DUI enforcement.  As a former DUI enforcement officer, my investigator assists me in interviewing witnesses, photographing the scene of the arrest, critiquing the police report, and evaluating potential defenses.  Having a DUI investigator "in house" helps provide clients with the best possible DUI defense.  

          I also work with a forensic alcohol expert who was formerly in charge of the Ventura County Sheriff's Department Crime Lab - Alcohol section and used to be the expert witness for the prosecution in DUI cases.  A forensic alcohol expert assists in projecting what your blood alcohol level was at the time of driving and revealing any inaccuracies there may be regarding your breath/blood test results.  

          The fact that your breath or blood test result may appear to be over the legal limit does not necessarily mean that you are guilty of drunk driving.  With respect to the .08% legal limit, the law is concerned with what your blood alcohol level was at the time of driving -- not when tested.  Depending upon what your test results are and when you finished drinking, your blood alcohol level may have been below the legal limit at the time you were driving even though your test results are above the legal limit.  The forensic alcohol expert that I work with is recognized state wide as one of the best experts at being able to project what your true blood alcohol level was at the time of driving.

          If you have already been convicted of a drunk driving charge in Ventura County you should consider having your conviction expunged after you have completed probation.  My office can assist you in having your DUI conviction expunged at the earliest possible time.

          For persons charged with drunk driving that do not live in Ventura County or even the State of California, there are ways to transfer the applicable penalties to the jurisdiction where you live so that you do not need to return to Ventura.
